Summary
California AB 130 (2025) is the omnibus housing budget trailer bill (Stats. 2025, ch. 22), effective June 30, 2025. Among its Civil Code amendments, it amended section 5850 to cap association monetary penalties at the lesser of the association's published fine schedule or $100 per violation; section 5850(d) permits a higher amount only for violations that may result in a health-and-safety threat, on a written finding adopted in open session. Before AB 130, section 5850 contained no statutory dollar cap.
