Effective: 2026-10-17. Applies to resale certificate orders placed through communitypay.us or the Title Company API.
CommunityPay is the software an association uses to prepare its resale certificates. CommunityPay charges you nothing and takes no part of any fee. The association, or the manager or accounting firm that keeps its books, prepares the certificate, bills its fee within the limit its state allows, and releases the certificate to you.
A resale certificate (or estoppel certificate, as the governing statute calls it) for the unit and association you identified on the order. Orders are taken only for associations that use CommunityPay. For any other association, ask its board or its management company.
The association's manager, its accounting firm, its treasurer, or a board member reviews the disclosures and generates the certificate from the association's books. The disclosures are the association's.
The association sets its fee within the limit its state's statute allows, and the association, or the manager or accounting firm that keeps its books, bills it to you by its own invoice or directly. CommunityPay takes no part of it, and you need no account with CommunityPay to pay it or to receive the certificate.
The certificate is released to you on your order page, and by callback for an API order, when the preparer releases it. In Nevada, Colorado, and Virginia a certificate is released by its statutory deadline unless the preparer records a reason to hold it.
The format and required content of each certificate is governed by the statute applicable to the property's location and the community type, including but not limited to: RCW 64.34.425 / RCW 64.90.640 (Washington), Cal. Civ. Code §§4525-4530 (California), ORS 94.670 (Oregon), Fla. Stat. §720.30851 / §718.116 (Florida), Tex. Prop. Code §207 / §82.157 (Texas), C.R.S. §38-33.3-316 (Colorado), and NRS 116.4109 (Nevada).
By placing an order, you warrant that:
CommunityPay provides the software that generates the certificate from the association's books; the disclosures are the association's. CommunityPay is not liable for indirect, consequential, or incidental damages arising out of an order. The certificate supports the disclosure review of a real-estate transaction. It is not legal advice.
To cancel an order before the certificate is released, contact the preparer named on your order page. A refund of a fee is the association's to give, and some statutes require one.
Information you provide is shared with the association and the people who prepare its certificates, to fulfill your order.
These terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles. The statutory framework applicable to the underlying certificate is the statute of the state in which the subject property is located.
